Acceptance of these terms

By accessing or using this website, you agree to these Terms of Use and to applicable law. If you do not agree, please do not use the site. These terms apply to the website and do not replace a signed contributor, photographer, vendor, advertising, sponsorship, licensing, or other agreement.

Personal and noncommercial use

You may view the site and use its content for ordinary personal, noncommercial purposes. You may:

• Share links to stories on this website and share official social-media posts.
• Quote reasonable, brief portions when legally permitted, with clear attribution to The Newton Community and a link to the original story.
• Print one copy of a story for private reading.
• Create a reasonable personal, noncommercial keepsake of a story in which you or an immediate family member was featured, including retaining or framing a personal copy for display in a home or private office.
• Give a small number of noncommercial copies to immediate family members.

This personal-use permission is limited and revocable. It does not transfer copyright ownership and does not permit a business or third party to sell or commercially exploit the material.

Commercial uses require written permission

Written permission from Tredeau Design, LLC is required before you or someone acting for you may:

• Reproduce complete articles or magazine pages commercially.
• Manufacture or sell plaques, framed articles, posters, prints, signs, canvases, books, apparel, gifts, or other merchandise containing publication content.
• Use photographs, illustrations, artwork, graphics, magazine covers, editorial layouts, or page designs commercially.
• Contact story subjects or featured businesses to sell products based on their appearance in The Newton Community.
• Use The Newton Community name, logo, magazine design, or visual identity in a way that suggests approval, sponsorship, endorsement, or affiliation.
• Republish content on another website, magazine, newsletter, book, database, app, video, or commercial publication; or syndicate, sublicense, resell, or commercially distribute it.
• Scrape or compile substantial portions of the site for a competing publication, commercial database, mailing list, automated content service, or machine-learning dataset.
• Remove or obscure copyright notices, credits, watermarks, or source information.

Content ownership

Unless otherwise noted, content published by The Newton Community is owned by or used with authorization by Tredeau Design, LLC. Online publication does not place content in the public domain. Other names, marks, and materials belong to their respective owners.

Prohibited conduct

You may not use the site to violate law or another person’s rights; interfere with security or normal operation; introduce malicious code; impersonate another person; make a false claim of affiliation, approval, sponsorship, or endorsement; evade access controls; harvest contact information; or remove credits, notices, watermarks, or source information.

Automated access and extraction

You may not use bots, crawlers, scrapers, automated agents, or similar means to extract or compile substantial portions of the site for a competing publication, commercial database, mailing list, automated content service, or machine-learning dataset without prior written permission. Ordinary search-engine indexing and security or accessibility tools used in accordance with applicable law are not the target of this restriction.

Submissions, messages, and forms

If you send a story idea, photograph, message, attachment, advertising inquiry, or other material, you confirm that you have the right to send it and that doing so does not violate another person’s rights. Submission does not guarantee publication, response, compensation, confidentiality, return, or retention.

You allow Tredeau Design, LLC and its editors, writers, photographers, and contractors to review and internally share a submission as reasonably needed to evaluate, contact you about, or produce a possible story. Publication rights, attribution, compensation, and other contributor terms may be addressed in a separate agreement. A separate agreement controls if it conflicts with these terms.

Accuracy, availability, and third-party services

The website and its content are provided on an “as available” basis. To the extent permitted by law, Tredeau Design, LLC disclaims implied warranties that cannot reasonably be supported, including warranties of uninterrupted availability, error-free operation, merchantability, fitness for a particular purpose, and non-infringement. Nothing here excludes a warranty or right that applicable law does not allow to be excluded.

We are not responsible for third-party websites, embedded services, or their content and practices.

Reasonable limitation of liability

To the fullest extent permitted by applicable law, Tredeau Design, LLC and those working with it will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, inability to use, or reliance on this site or a linked service. This limitation does not apply where applicable law prohibits it, and it does not limit liability that cannot lawfully be limited.

Enforcement and takedown

We may restrict access, remove material, preserve relevant records, contact a user or service provider, send notices, or pursue other appropriate remedies when we reasonably believe these terms, applicable law, or another person’s rights have been violated. A delay in enforcement is not a waiver of a right.

Changes, severability, and non-waiver

We may update these terms by posting a revised version and changing the “Last updated” date. Continued use after a change means the updated terms apply to future use. If a provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. Failure to enforce a provision once does not waive future enforcement.
